Terms of service
The terms under which you use Soundscaper.
The agreement between you and Kenjin covering accounts, subscriptions, what you may do with the soundscapes you compose, safety, and limitations. Working document; final lawyer review pending before launch.

Introduction
These terms govern your use of Soundscaper (the “Service”), provided by Kenjin (“we”, “us”), a company registered in England and Wales. By creating an account, you agree to these terms. If you don't agree, please don't use the Service.

What the Service is
Soundscaper composes personalised therapeutic soundscapes from your structured intake. It runs the composition pipeline on your own device. It delivers compressed downloads as portability copies and, for subscribers, clean unwatermarked playback through the mobile app.
The Service is wellness-adjacent listening, not clinical treatment.Soundscaper is not a medical device. It doesn't treat, diagnose, prevent, or cure any clinical condition. If you're in crisis or need clinical care, please use the routes at /help.

Eligibility
You must be 18 or older to use the Service. You must confirm at intake that you don't have any of the listed contraindications — epilepsy or seizure history, vestibular disorders, pacemaker or implanted cardiac device, current pregnancy where binaural induction is contraindicated by your clinician. You must not use the Service while operating machinery or driving.

Your account
- You're responsible for keeping your account credentials secure.
- You may not share your account or transfer it to anyone else.
- You may delete your account at any time via the Account hub at /account.
- We may suspend or terminate accounts that violate these terms — for example, attempting to evade rate-limits, sharing access, or misusing the Service in a way that creates safety risk to themselves or others.

Subscriptions, credits, and refunds
Pricing is published at /subscriptions. The model has three parts:
- Single Session — pay-per-composition. No recurring charge. The session is yours to download and keep.
- Monthly Practice— three compositions per month, plus clean app playback. Cancel any time. Credits don't roll over.
- Companion — five compositions per month, two listener profiles, care-mode player.
If a subscription lapses, you keep three months of hosted access to your existing library. After ninety days, master files become eligible for deletion. Compressed downloads on your devices remain yours.
Refunds are handled per the platform policy of the payment provider used at point of purchase (Stripe, App Store, Play Store). Where local consumer-protection law (UK Consumer Rights Act, EU Consumer Rights Directive) provides additional rights, those rights apply.

What you may do with your soundscapes
Soundscapes you compose are licensed to you for personal, non-commercial listening — including listening with members of your household and, on the Companion plan, the second listener profile.
You may not, without our prior written consent:
- Distribute, sell, or sublicense your composed soundscapes commercially.
- Use the soundscapes as training data for any AI model.
- Strip the watermark, intro, or burn-in cues from the compressed download files.
- Use the Service in any clinical or therapeutic-treatment context that would require medical-device regulatory clearance (FDA, MHRA, EU MDR, or similar).

Safety and crisis routing
Crisis-indicator language at intake will route you to support resources rather than generate a session. The Help page at /help lists the routes available.
Stop the Service immediately if you experience headache, dizziness, nausea, light-headedness, or any unusual sensation that doesn't pass quickly. Discontinue and consult a clinician if symptoms persist.

Intellectual property
The Service, the composition engine, the recipe library, the visual identity, the brand name, and the website content are owned by Kenjin or licensed to us. Soundscapes you compose are licensed to you for personal use as set out above.
The stem library used by the composition engine is curated under explicit per-stem licensing. Where we identify a stem licence as incompatible with our use, we remove it.

Disclaimer of warranties
The Service is provided “as is”. We make reasonable efforts to keep the Service available and the audio renders technically sound, but we don't warrant that the Service will be uninterrupted or error-free, nor that any specific therapeutic outcome will result from using it. Music-based listening is supportive; outcomes are individual.

Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from your use of the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) £100. Nothing in these terms limits liability that cannot be limited under UK law — for example, liability for death or personal injury caused by negligence, or liability for fraud.

Changes to these terms
We may revise these terms over time. Material changes are notified by email to active accounts at least 14 days before they take effect, and the “last updated” date at the top of this page will reflect the change.

Governing law and disputes
These terms are governed by the law of England and Wales. Disputes will be subject to the exclusive jurisdiction of the English courts, except where mandatory consumer law in your country of residence provides otherwise.
